Federal law requires them to use the same label as the name brand.
They could face serious liability if they failed to do so.
Then the states wanted a different label. They were threatened with lawsuits for not using those labels.
What were they supposed to do? Damned if they do, damned if they don't.
The SC is correct. Federal law trumps state law. If the federal law is bad, it needs to be changed at the federal level.
Note, the SC did not rule on whether the federal law is good or bad. It could be the worst law ever written. I don't know, I haven't read it. But it doesn't matter. You can't fix bad federal laws at the state level.
Once again, the Supreme Court rewards the corporations over the citizens. This is the worst S.C. in the history of our nation. They are openly taking bribes, Thomas, for instance, hasn't even SPOKEN in the Court once since he was put on it. They are both incompetent and corrupt, and America should be ashamed of this Court!
They were aware the drugs did NOT actually reflect the labels. As the provider they are responsible to take actions to prevent people from being injured. That they didn't even try is where they fell down and are liable. KNOWING that injury will occur and not doing anything is criminal. The Court is wrong.
The Feds and the State should be using the EXACT SAME label to ensure that there is hinderence on warning label clarity.
I am unsure what's going on with the courts these days. It seems as if someone is slipping them a check under the table. The system of Checks and Balances doesn't work if corporations are sending all of the branches of government checks themselves.

Good thing I'm not on the SC. If the Fed requires one label, and the state requires another. I'd say they have to use both labels.
